Terms and conditions of sale
Version of 27/10/2026. This is a translation of the French terms and conditions of sale (CGV); in case of discrepancy, the French version prevails.
Article 1 – Identification, purpose and scope
These general terms and conditions of sale (the “Terms”) govern every sale concluded on the website www.microbrassage.com (the “Site”) between:
- SARL Canard Rouge, a limited liability company with a share capital of €12,000, whose registered office is at 4 rue Sépat, ZAC Sépat, 82370 Campsas, France, registered with the Montauban Trade and Companies Register (RCS) under number 823 817 895, intra-community VAT number FR09823817895, who can be reached by email at contact@canardrouge.com or by telephone on +33 (0)7 45 13 57 35 (“Canard Rouge”);
- and any natural person or legal entity placing an order on the Site (the “Buyer”).
For the purposes of these Terms:
- Consumer: any natural person who buys for purposes outside their commercial, industrial, craft, professional or agricultural activity.
- Professional: any natural person or legal entity who buys for the needs of their business, including a brewery, a company, an association or a public body.
The Buyer declares their status when creating an account or placing an order. Clauses reserved for one category are marked “Consumers” or “Professionals”.
Placing an order constitutes unreserved acceptance of these Terms, which the Buyer acknowledges having read before ordering. The Terms applicable are those in force on the date of the order; Canard Rouge may amend them at any time.
Professionals: these Terms form the sole basis of the commercial relationship. The Buyer’s general terms of purchase do not apply, unless Canard Rouge agrees otherwise in writing.
Article 2 – Products
The products offered are those shown on the Site on the day of consultation, while stocks last. Canard Rouge may change its range at any time. Each product page gives the main characteristics: material, standard (Clamp, DIN, SMS, BSP, John Guest…), dimensions and connection. Photographs are for illustration only and are not contractually binding.
Before ordering, the Buyer checks that the product suits their installation: compatibility of standards and diameters, pressure, temperature, type of fluid. Installation, commissioning and compliance with applicable regulations (pressure equipment, electrical equipment, materials in contact with foodstuffs) are the Buyer’s responsibility.
If an ordered product becomes unavailable, Canard Rouge informs the Buyer by email and offers a new delivery time, an equivalent product or a refund.
Made-to-measure and cut-to-length products: made-to-measure stainless steel parts are manufactured to the Buyer’s specifications, after a written quote has been accepted; products sold by the metre (tubing and pipes, for example) are cut to the length requested. These products are neither taken back nor exchanged, unless they do not match the quote or the order.
Article 3 – Prices
Prices are shown in euros, excluding VAT for Professionals and including all taxes for Consumers, based on the VAT rate applicable on the day of the order. Any change in this rate may be passed on in the prices.
Canard Rouge may change its prices at any time; the price applicable is the one displayed on the day of the order. Quotes are valid for 30 days.
Delivery costs are not included in the product price. They are calculated in the basket according to the destination, weight and amount of the order, and shown to the Buyer before confirmation.
Article 4 – Ordering and customer account
The Buyer may order with or without a customer account. The account is accessible from the Site menu; in it the Buyer states their status (Consumer or Professional) and, for a Professional, their company name, SIRET number and VAT number. The Buyer keeps their login details confidential and is responsible for their use.
The order process is as follows: selecting products in the basket, checking quantities and references, entering or checking the delivery address, display of delivery costs and carrier, choice of payment method, acceptance of the Terms by ticking a box, then clicking the “Order with obligation to pay” button.
This last click concludes the contract. Canard Rouge then confirms the order by email.
Canard Rouge may refuse or cancel an order in the event of a prior dispute with the Buyer, an incorrect address, suspected fraud or an obvious pricing error, and informs the Buyer accordingly. Order data constitutes proof of the transaction. Canard Rouge keeps orders and invoices in accordance with its legal obligations.

Article 5 – Payment
Payment is due in full at the time of the order, by one of the methods offered at checkout: bank card and PayPal via a secure interface, bank transfer, or cheque made payable to “SARL Canard Rouge”.
For payment by bank transfer or cheque, the order is processed once the funds are received and shipped at the earliest 2 working days after payment is cleared; cheques are sent to the address given in Article 4. No cash payment should be sent.
In the event of fraudulent remote use of their bank card, the card holder may dispute the payment in writing with their bank within the periods set by their contract and by law (70 days, up to 120 days depending on the contract). Sums rightly disputed are credited back at no cost to the card holder.
Professionals: unless deferred payment has been agreed in writing, no discount is granted for early payment. Any late payment automatically incurs, from the day after the due date and without formal notice, penalties calculated at three times the legal interest rate, together with a fixed compensation of €40 for recovery costs (articles L441-10 and D441-5 of the French Commercial Code), without prejudice to additional compensation on proof. Canard Rouge may suspend any delivery in the event of non-payment.
Article 6 – Retention of title
Canard Rouge retains ownership of the products sold until full and effective payment of the price, including principal, costs and taxes. This clause does not change the transfer of risk, which is governed by Article 7.
Article 7 – Delivery
Products are delivered to the address given in the order, in France (including overseas territories), in the European Union and in many other countries, according to the zones offered at the time of the order. The carriers offered are Colissimo (La Poste, with or without signature, or to a relay point) and DPD (home delivery by appointment, delivery to a workplace or to a relay point), as well as, depending on the destination, the tracked parcel services shown in the basket. Canard Rouge may send the tracking number by email.
Products are shipped within an indicative period of 2 to 5 working days after receipt of payment. Where no delivery time is stated, delivery takes place within thirty days of the order at the latest. After that period, the Buyer may cancel the contract in writing and be refunded; Consumers also have the remedies provided for in articles L216-2 and L216-3 of the French Consumer Code.
Transfer of risk. For Consumers, risk passes on delivery of the parcel. For Professionals, risk passes as soon as the products are handed to the carrier at Canard Rouge’s premises.
Checking on delivery. The Buyer checks the packaging and contents in the presence of the delivery person or relay point. In the event of damage or missing items, the Buyer states precise reservations on the delivery note and confirms the complaint to the carrier, with a copy to Canard Rouge, within three days of delivery (excluding Sundays and public holidays).
Deliveries outside France. For a Professional established in the European Union, delivery is exempt from VAT on presentation of a valid intra-community VAT number. For delivery outside the Union, customs duties, taxes and import formalities are the Buyer’s responsibility.
Article 8 – Right of withdrawal
Consumers. The Consumer has fourteen calendar days from receipt of the products to withdraw without giving a reason (article L221-18 of the French Consumer Code). They notify Canard Rouge of their decision using the form in the appendix or any unequivocal statement (email or letter), then return the products no later than fourteen days after this notification, to the address given in Article 4. Return costs are borne by the Consumer. Products are returned complete, in good condition and in their original packaging; the Consumer is liable for any loss in value resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the goods.
Canard Rouge refunds all payments, including standard delivery costs, within fourteen days of receiving the notification. It may defer the refund until the products have been recovered or proof of their dispatch has been provided.
The right of withdrawal does not apply to products made to the Consumer’s specifications or clearly personalised, in particular made-to-measure parts and products sold by the metre or cut to the length requested by the Consumer, such as tubing and pipes (article L221-28 of the French Consumer Code).
Professionals. No right of withdrawal applies. A return is only accepted with Canard Rouge’s prior written agreement, for a new, unused product in its original packaging, returned at the Buyer’s expense, except in the case of a lack of conformity. Canard Rouge may apply a deduction or reconditioning costs.
Article 9 – Warranties and claims
Consumers. The Consumer benefits from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code), for two years from delivery of the goods: during this period, a lack of conformity is presumed to have existed at the time of delivery, and the Consumer chooses between repair and replacement, under the conditions of the law. The Consumer also benefits from the warranty against hidden defects (articles 1641 et seq. of the French Civil Code), which may be invoked within two years of discovering the defect. These guarantees apply at no cost to the Consumer and are not limited by these Terms.
Professionals. Canard Rouge is liable for the warranty against hidden defects (articles 1641 et seq. of the French Civil Code). It also grants a contractual warranty of 12 months from delivery against defects in materials and workmanship, with repair, replacement or refund of the product, at Canard Rouge’s choice. Excluded: normal wear, incorrect installation or use, unsuitable fluid or temperature, overpressure, dry running of pumps, lack of maintenance and any modification of the product by the Buyer.
Claims. Any claim is sent by email or by post to Canard Rouge, with the order number, a description of the defect and photographs. For Professionals, visible defects must be reported within 30 days of delivery, and hidden defects as soon as they are discovered. If the defect is acknowledged, Canard Rouge bears the return costs.
Article 10 – Liability and force majeure
For distance selling, Canard Rouge has an obligation of means only. It is not liable for damage resulting from the use of the Internet, such as loss of data, intrusion, viruses or service interruption.
Professionals. Canard Rouge’s liability is limited to the amount, excluding VAT, of the order concerned. It excludes indirect damage, in particular loss of operation, production or raw materials (for example a batch of beer) and loss of profit. This limit does not apply in the event of wilful misconduct, gross negligence or personal injury.
Consumers. Nothing in these Terms limits the rights the law gives them.
Force majeure. Canard Rouge is not liable for a failure caused by an event of force majeure within the meaning of article 1218 of the French Civil Code, in particular strikes, supply disruption, carrier failure or exceptional weather events. Performance is then suspended; if it lasts more than 60 days, either party may terminate the order.
Article 11 – Intellectual property
All elements of the Site (texts, photographs, diagrams, instructions, logos, visuals, structure) are the exclusive property of Canard Rouge. Any reproduction, use or exploitation, even partial, is prohibited without its prior written consent.
Article 12 – Personal data and commercial communications
Canard Rouge, as data controller, collects the Buyer’s data (identity, contact details, delivery address, order history and, for Professionals, company name, SIRET and VAT number) in accordance with Regulation (EU) 2016/679 (GDPR) and the French law of 6 January 1978 as amended. The privacy policy, accessible from the Site, details this processing, its legal bases and retention periods, in particular:
- processing, delivery and invoicing of orders: performance of a contract and legal obligation; duration of the relationship, then 10 years for accounting records;
- customer account management: performance of a contract; until the account is deleted, or 3 years without activity;
- newsletter and commercial offers: consent (Consumers) or regulated legitimate interest (Professionals); until unsubscription, and 3 years after last contact;
- fraud prevention: legitimate interest; as long as strictly necessary.
The data is intended for Canard Rouge and its service providers (payment, transport, hosting, sending of emails), within the limits of their tasks. Some providers, in particular Google, may process data in the United States, under the safeguards provided by the GDPR (adequacy decision or standard contractual clauses).
The Buyer has the right of access, rectification, erasure, restriction, objection and portability, and may set directives for what happens to their data after their death. They exercise these rights by email to contact@canardrouge.com or by post to the address in Article 4, and may lodge a complaint with the CNIL (www.cnil.fr).
Commercial communications (newsletter). Canard Rouge may send by email news, restocks, promotions and technical advice:
- Consumers: only with their prior consent, given by an unticked checkbox separate from acceptance of the Terms, when creating an account or ordering. If they were offered the possibility of objecting to prospecting when their address was collected, Canard Rouge may also offer them products similar to those they have already bought (article L34-5 of the French Postal and Electronic Communications Code).
- Professionals: the business email address may be used for offers related to their activity, the Buyer being informed here and when the address is collected of their right to object at any time, free of charge.
- All Buyers: each message states the sender’s identity and contains a one-click unsubscribe link. Acceptance of the Terms does not constitute consent to prospecting.
Article 13 – Mediation, governing law and disputes
Consumers. In accordance with the provisions of the French Consumer Code concerning “the consumer dispute mediation process”, after contacting us and if our reply does not satisfy you, you may use a consumer mediation procedure free of charge with:
